How Delta 8 THC Affects Drug Tests

Everyone likes to unwind now and then. You can decide to watch a game, read a book, go to a concert, or smoke some Delta 8 THC. The decision is yours. However, smoking some Delta 8 THC would be less stressful if you did not have to worry about whether you will pass a drug test.

While the legal state of Delta 8 THC is not that clear, you may be worried that your employer would not take kindly to you having some in you. Therefore, you should always be prepared with the knowledge you need when it comes to drug tests.

Is Delta 8 THC Legal?

Companies often administer drug tests to ensure that the subject of the drug test has not consumed any illegal or prohibited substances. Most organizations do not want to employ people who use illicit substances. In such cases, one of the things to consider while passing a drug test when using delta 8 is whether it is legal and permissible in your area. As with any legal question, the simple answer is, “It depends.”

Judges hammer and books

Federal laws are unclear about the specific legal stature of Delta 8 THC. The Farm Bill of 2018 legalized different products derived from the hemp plant. While the statute does not expressly state that Delta 8 THC is legal, courts have interpreted this statute to support the legalization of Delta 8 THC. The court noted that the definition of hemp per the statute includes any part of the cannabis plant with 0.3 percent delta-9 THC by weight.

Thus, since the statute is silent on Delta 8, Delta 8 THC can be legal. However, this ambiguity may not be suitable for you in the event of a drug test.

Why Do Drug Tests Show Delta 8 If It Is Not Illegal?

To answer this question, you must understand the difference between Delta 8 and 9 THC. THC is the tetrahydrocannabinol compound of the cannabis plant. Chemically, the difference between Delta 8 and Delta 9 THC is seen in the differences between where the carbon bond is on the different isomers. While the technical differences between the two are interesting, you are probably more concerned about the physical differences. Delta 9 has a more potent and longer-lasting high than Delta 8. Thus, Delta 8 does not have the unpleasant effects of being high such as paranoia or the rapid heart rate. Additionally, when deriving Delta 8 from cannabis, the filtration process removes Delta 9. However, in some instances, some traces may remain.

How Do Drug Tests Work?

You may take a drug test now and then because of state laws or institutional policies. Employers have different types of drug tests to choose from depending on what drugs they are looking to find. Examples of drug tests include blood tests, hair follicle tests, and urine analysis or urinalysis tests. The most common drug test is the urine test.

The urine test is done to detect the presence of toxins in your urine. The science behind the test is that the drug enters the bloodstream when one smokes any drug. When the blood reaches the kidney, the kidney removes the toxins from the blood and filters them into the urine. Therefore, when they test your urine, these toxins will be present in your urine, thus indicating positive drug use.

Delta 8 and the Drug Test

You already know that the drug test will always test positive for using Delta 9. However, you may be wondering what the situation is for the Delta 8 isomer. The answer to this question is not as clear-cut as you would want it to be. It depends on various factors, such as the drug test used and how long ago you took the Delta 8.

In most instances, Delta 8 is likely to test positive in a drug test. However, most drug tests look to identify whether the THC component is present in your urine. Thus, since both Delta 8 and Delta 9 contain THC, the test can indicate the presence of THC in your urine.

In such instances, you may want to inform the person testing you that you used Delta 8 and not Delta 9 and seek a confirmatory test.

The best bet you have to pass a drug test is to avoid using drugs. This answer is probably not what you are looking for, right? You could go through a natural detox by taking a detox drink to reduce the number of toxins in your urine.

You could also use synthetic urine to pass as your urine in case no one is monitoring your drug test. Changes in law will alleviate your concerns about using Delta 8 and drug tests as the year’s signs of progress. Legislatures are constantly making changes to the laws affecting hemp and its use.
